How to Report

New Mexico (NM)

Who is required to report?

Citation: Ann. Stat. § 32A-4-3

Professionals required to report include the following:

  • Licensed physicians
  • Residents or interns
  • Law enforcement officers or judges
  • Registered nurses or visiting nurses
  • School employees
  • Social workers acting in their official capacity
  • Members of the clergy

When is a report required?

Citation: Ann. Stat. § 32A-4-3

A mandated reporter who knows or has reasonable suspicion that a child is abused or neglected shall report the matter immediately.

What information should the report include?

Citation: Ann. Stat. § 32A-4-3(B)

Written report must contain:

  • Names and addresses of the child and the child’s parents, guardian, or custodian
  • Age of the child
  • Nature and extent of the child’s injuries, including evidence of previous injuries
  • Other information that may be helpful in establishing the cause of injuries and the identity of the person responsible for the injuries

Written report shall be submitted on a standardized form agreed to by the law enforcement agency and the department.

Failure to report

Citation: Ann. Stat. § 32A-4-3(F)

Any person who violates the provisions of this section pertaining to the duty to report is guilty of a misdemeanor and shall be sentenced pursuant to § 31-19-1.

Upon conviction, the person shall be imprisoned in the county jail for a definite term that is less than 1 year, be fined not more than $1,000, or both at the discretion of the judge.
