How to Report

Kentucky (KY)

Who is required to report?

Citation: Rev. Stat. § 620.030

All persons are required to report, including, but not limited to, the following:

  • Medical and health professionals, including:
    • Physicians
    • Osteopathic physicians
    • Nurses
    • Coroners
    • Medical examiners
    • Residents
    • Interns
    • Chiropractors
    • Dentists
    • Optometrists
    • Emergency medical technicians
    • Paramedics
    • Other health professionals
  • Education and child care personnel, including:
    • Teachers
    • School personnel
    • Child care personnel
  • Social workers or mental health professionals
  • Peace officers

When is a report required?

Any person who knows or has reasonable cause to believe that a child is abused or neglected shall immediately make an oral or written report, by telephone or otherwise.

A mandated reporter shall file a written report within 48 hours of the original report, if requested.

Any person who knows or has reasonable cause to believe that a child is a victim of human trafficking shall immediately cause an oral or written report to be made to a local law enforcement agency, the Department of Kentucky State Police, the cabinet or its designated representative, or the Commonwealth's attorney or the county attorney by telephone or otherwise. This subsection shall apply regardless of whether the person believed to have caused the human trafficking of the child is a parent, guardian, fictive kin, person in a position of authority, person in a position of special trust, or person exercising custodial control or supervision.

What information should the report include?

Initial reports do not have specific content requirements.

To the extent a written report is requested, that written report must contain the following:

  • The names and addresses of the child and the child’s parents or other persons exercising custodial control or supervision
  • The child’s age
  • The nature and extent of child’s alleged dependency, neglect, or abuse, including any previous charges of dependency, neglect or abuse to the child or his or her siblings
  • The name and address of person allegedly responsible for the abuse or neglect
  • Any other information that the reporter believes might be helpful or relevant

Failure to report

Citation: Rev. Stat. § 620.030(6)

Any person who intentionally violates the provisions of this section shall be guilty of one of the following:

  • A class B misdemeanor for the first offense
  • A class A misdemeanor for the second offense
  • A class D felony for each subsequent offense
